Photos used in MLS listings are protected under U.S. copyright law the moment they're created. By default, the photographer holds the copyright, not the agent, broker, or MLS. That’s why proper attribution and usage rights aren’t just best practices—they’re legal requirements.

To ensure transparency and compliance, REsides requires photographer information to be entered when listing photos are uploaded. This isn’t just a formality:

Legal Protection: Under the U.S. Copyright Act (Title 17, Sections 102 & 106), only the copyright holder can grant the rights to use, reproduce, or display images.

Clear Ownership Chain: REsides maintains agreements with photographers that transfer the rights to use listing photos. Identifying the original photographer helps document the source and ensures the photos are used in accordance with those agreements.

Safeguard for All Parties: This process protects everyone involved—agent, broker, MLS, and platform—from legal risks related to unauthorized image use.

Always enter the correct photographer details when uploading listing photos.

Ensure there is a signed agreement—either a usage license or full copyright assignment (ideally marked as a “work made for hire”).

Do not reuse images from other listings without clear, documented permission.

Don't see your listing on third-party websites?
First, ensure you have selected 'Yes' in the IDX Opt In field, as seen below.

Once your listing is set to Active status or changes are made in the MLS, please note that third-party websites update their data feeds at different intervals that can range from 15 minutes to 4 hours.

If you do not see your listing or the changes after the expected update window, please contact your account manager by phone or email help@resides.io. Be sure to include the MLS# in your message or have it ready when you call.
